This Privacy Policy explains how The Roads Report, operated by Max Cufari, a licensed Florida real estate broker affiliated with Berkshire Hathaway HomeServices EWM Realty and the Scott Shuffield Group ("we," "us," or "our"), collects, uses, discloses, and protects information about you when you visit theroadsreport.com (the "Site") or contact us. Please read this policy carefully. By using the Site, you agree to the practices described herein.

1. Information We Collect

Information You Provide Directly

When you submit a form on the Site — including the market report request form, the home value inquiry form, or the contact form — we collect the following categories of personal information:

  • Full name
  • Property address or mailing address
  • Email address
  • Phone number (when provided)
  • Message content and any details you include voluntarily
  • Your stated status as a current resident, prospective buyer, or other

Providing this information is voluntary, but certain fields are required for us to respond to your inquiry or fulfill your request.

Information Collected Automatically

When you visit the Site, we and our third-party service providers automatically collect certain technical information, including:

  • IP address and approximate geographic location derived from it
  • Browser type, version, and language settings
  • Device type, operating system, and screen resolution
  • Pages visited, time spent on each page, and navigation paths
  • Referring website or search engine query that directed you to the Site
  • Date and time of each visit
  • Cookie identifiers and similar tracking technologies (see Section 4)

Information from Communications

We do not use your personal information for automated decision-making or profiling that produces legal or similarly significant effects.

3. Third-Party Service Providers

Formspree (Form Processing)

Form submissions on the Site are processed by Formspree, Inc. When you submit a form, your data is transmitted to Formspree's servers and forwarded to our email. Formspree's privacy practices are governed by their own privacy policy, available at formspree.io. By submitting a form on the Site, you acknowledge that your data will pass through Formspree's infrastructure.

Google Analytics

We use Google Analytics 4 (GA4), a web analytics service provided by Google LLC, to understand how visitors interact with the Site. Google Analytics collects information such as pages visited, session duration, device type, and approximate location. This data is aggregated and anonymized. Google's use of this data is governed by the Google Privacy Policy (policies.google.com/privacy). You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on (tools.google.com/dlpage/gaoptout) or by adjusting your browser's cookie settings.

WordPress and Web Infrastructure

The Site is built on WordPress and hosted by InMotion Hosting. Standard server-side data — including access logs, IP addresses, and request metadata — may be retained by the hosting provider in accordance with their own data retention policies.

Berkshire Hathaway HomeServices EWM Realty

As a licensed broker affiliated with Berkshire Hathaway HomeServices EWM Realty, certain transaction-related information may be shared with that brokerage in connection with the provision of real estate services. This sharing is governed by applicable real estate licensing law and the brokerage's own privacy practices.

4. Cookies and Tracking Technologies

The Site uses cookies and similar tracking technologies to operate effectively and to analyze usage. Cookies are small text files placed on your device by your browser.

Types of Cookies We Use

  • Essential cookies: Required for the Site to function. These include session cookies set by WordPress and our caching provider. They cannot be disabled without affecting Site functionality.
  • Analytics cookies: Set by Google Analytics to collect aggregated, anonymized data about Site usage. These help us understand which content is most useful to visitors.
  • Performance cookies: Set by our caching and optimization infrastructure (WP Rocket) to deliver fast page load times.

Managing Cookies

We do not currently respond to Do Not Track (DNT) signals, as no uniform standard exists for their interpretation.

  • Service providers: As described in Section 3, we share data with vendors who assist in operating the Site and delivering our services, including Formspree and Google Analytics.
  • Affiliated brokerage: Information related to a real estate transaction or client engagement may be shared with Berkshire Hathaway HomeServices EWM Realty and the Scott Shuffield Group as required by law or brokerage policy.
  • Legal compliance: We may disclose your information if required to do so by law, regulation, court order, subpoena, or other governmental or regulatory process.
  • Protection of rights: We may disclose information where we believe it necessary to protect the rights, property, or safety of The Roads Report, our clients, or the public.
  • Business transfer: In the event of a sale, merger, acquisition, or restructuring of our business, your information may be transferred to a successor entity, subject to the same privacy commitments described in this policy.

6. Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, to maintain our business records, and to comply with applicable legal, regulatory, and professional obligations.

  • Form submissions and contact inquiries: retained for a minimum of three (3) years from the date of submission, or longer if a client relationship develops
  • Market report subscriber information: retained for as long as you remain a subscriber, plus one (1) year after you unsubscribe or request removal
  • Server access logs: retained per our hosting provider's standard retention schedule
  • Analytics data: retained in accordance with Google Analytics' default retention settings, which may be adjusted in our GA4 account settings

When personal information is no longer needed, we take reasonable steps to delete or anonymize it.

7. Security

We take reasonable and appropriate technical and organizational measures to protect the personal information we collect from unauthorized access, disclosure, alteration, and destruction. These measures include SSL/TLS encryption for data transmitted to and from the Site, access controls, and regular security monitoring.

However, no method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee absolute security. You transmit information to the Site at your own risk.

In the event of a data breach that affects your personal information, we will notify affected individuals as required by applicable Florida law (Florida Information Protection Act, Fla. Stat. § 501.171) and any other applicable regulations.

9. California Consumer Privacy Act (CCPA)

If you are a resident of California, you have specific rights under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (collectively, "CCPA/CPRA").

Categories of Personal Information Collected

In the past twelve months, we have collected the following categories of personal information as defined under the CCPA: identifiers (name, email address, IP address); personal information described in Cal. Civ. Code § 1798.80(e) (mailing address, telephone number); internet or other electronic network activity information (browsing history on the Site); geolocation data (approximate location derived from IP address); and inferences drawn from such information.

Your California Rights

  • Right to know what personal information is collected, used, shared, or sold
  • Right to delete personal information we hold about you
  • Right to opt out of the sale or sharing of personal information (note: we do not sell or share personal information for cross-context behavioral advertising)
  • Right to non-discrimination for exercising your CCPA rights
  • Right to correct inaccurate personal information
  • Right to limit use of sensitive personal information (we do not collect sensitive personal information as defined by the CPRA)

To submit a CCPA request, contact us at max@theroadsreport.com with "CCPA Request" in the subject line. We will verify your identity and respond within forty-five (45) days, with an extension of an additional forty-five (45) days where reasonably necessary.

10. International Visitors

The Site is intended for use by persons located in the United States. If you access the Site from outside the United States, including from the European Economic Area, United Kingdom, or other jurisdictions with data protection laws, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection standards may differ from those in your home country.

If you are located in the European Economic Area or United Kingdom, you may have additional rights under the General Data Protection Regulation (GDPR) or applicable national law, including the right to lodge a complaint with a supervisory authority. Our legal basis for processing personal information from EEA/UK residents is legitimate interest (to respond to inquiries and provide real estate services) and, where applicable, your explicit consent.

By using the Site and submitting information to us, you consent to the transfer of your information to the United States and its processing as described in this policy.

11. Children's Privacy

The Site is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. If we learn that we have inadvertently collected personal information from a child under 13, we will promptly delete that information.
