Any dispute, controversy, or claim arising out of or relating to these Terms or the Site shall be resolved as follows:
Before initiating formal proceedings, you agree to first contact us at max@theroadsreport.com and attempt to resolve the dispute informally for a period of thirty (30) days.
If informal resolution fails, any dispute shall be finally resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, with one arbitrator, conducted in Miami-Dade County, Florida. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction in Miami-Dade County, Florida, to prevent irreparable harm pending arbitration.
We reserve the right, in our sole discretion, to terminate or restrict your access to the Site at any time, with or without notice, for any reason, including if we believe you have violated these Terms or engaged in conduct harmful to us, other users, or third parties.
Upon termination, all licenses and rights granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including Sections 8, 12, 13, 14, and 15.
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. For material changes, we may provide additional notice, such as a prominent notice on the Site.
